  • My Legal Briefcase

I just found out that my wife did not tell me the truth about her income when we were working on our separation agreement. It turns out that she makes twice as much money as she said she did. Now that I know this, I think I am paying her too much support. What can I do?

This is one of the few situations in which you can go to court to ask a judge to change your separation agreement. Usually a judge will not change what a couple has agreed to in a separation agreement. However, a judge can change the agreement if he or she finds that a person was not honest and did not provide accurate information about income, property or debts when the agreement was made.
