    If mediation doesn't work, can the mediator tell the court what was said during mediation?

    It depends on whether you have chosen 'open' or 'closed' mediation. Before mediation starts you and your spouse will decide this issue. In open mediation, the mediator writes a full report on what happened during mediation and can include anything that he or she thinks is important, and that information is available to the court. In closed mediation, the mediator's report will only say what agreement you reached, or that you did not reach an agreement.
