    Can the court serve my documents for me?

    Ontario Small Claims Court clerks are required to serve your defence on the plaintiff on your behalf. The fee for this service is included with the filing fee. This means that you must file at least three copies of the defence (one for the court, one for your purposes, and one to be served on the defendant).



    For service of a claim in Small Claims Court, you can pay the court clerk to mail your claim to the person you are suing by certified mail. This can be very convenient and the fee is low ($10 in Ontario). You should check back with the court before the hearing to see if the receipt for certified mail was returned to the court. Service by certified mail is complete on the day the certified mail receipt is signed.
