    Can I move with the children if the court has given me custody?

    This is an issue of mobility rights. The best interests of the child will prevail when the court considers whether or not to allow a custodial parent to move with the children. Where a parent wants to move away because of a better job opportunity, to live with a new spouse, or to be closer to family, the courts will primarily consider the impact that such a move would have on the child. If there is an indication that there will be a negative impact on the child, the court may refuse to allow the child to be moved.
