    CEO Monica Goyal Interviews on This Week in Law

    On August 10, 2012, CEO and Founder of My Legal Briefcase Inc., Monica Goyal, was interviewed by Denise Howell on This Week in Law, a weekly internet show streaming on TWiT.TV. Ms. Goyal was on the showÂ’s panel discussing breaking issues in technology and law, including issues related to patents and copyright.

    The discussion involved several recent cases of Flava Works versus myVidster and Electronic Arts versus Zynga as well as individualsÂ’ rights to access and broadcast content online and how they are constrained by intellectual property laws. myVidster involved an action for copyright infringement. Flava Works claimed that links to Flava created on myVidster permitted free access to videos (which were protected materials) and allowed users to view them for free instead of paying for them on Flava Works. The court decided that myVidster was not an infringer. One interesting point raised during the discussion is the fact that the decision did not involve the safe harbor provision (section 512 of the Online Copyright Infringement Liability Limitation Act). Since no party was found to be an infringer, there was no reason to raise the safe harbor protection.

    The panel also discussed copyright infringement issues in the context of advertising during the Olympics. Specifically, the discussion was centered on who was allowed to use Olympic logo and be associated with the recent Olympic Games inLondon. As there are many laws and rules that govern who can do so, a point was raised on how far these rules go in terms of protecting the Olympic brands and whether they are necessary at all.
